Settlement Agreements

 

Although it is usually the employer who makes the first move with proposing a Settlement Agreement under S111A Employment Rights Act 1996, the employee (or their legal representative) can also propose a settlement agreement in circumstances when the relationship is either untenable or simply ran its course. This is a statutory right.

A settlement agreement proposal can be made at any stage of the employment relationship, regardless of whether any formal disciplinary performance management process has been started.
